Privacy Policy
Introduction
Crisis Cover Pty Ltd. (“TraveDoc” or “we” or “us”) offers an online network (the “Network”) to connect patients traveling abroad who are seeking medical assistance with local physicians and dentists (physicians and patients may be referred to collectively in this privacy policy as “users” but may be referenced individually where appropriate; references to physicians are intended to encompass physicians and dentists). This privacy policy is designed to inform users of the Network about how TraveDoc gathers and uses personal information collected by us in connection with the Network. We will take reasonable steps to protect user privacy consistent with the guidelines set forth in this privacy policy and with applicable U.S. laws. In this privacy policy, “user” or “you” means any person using or otherwise benefiting from the Network, registering with us by creating an account, or participating in any other activities available through the Network. BY ACCESSING OR USING THE NETWORK, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY AND OUR NETWORK TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE NETWORK.
WE ARE CURRENTLY IN A BETA TESTING PHASE! DURING THIS PHASE, WE ARE PROVIDING THE SERVICE “AS IS”. THIS AGREEMENT SETS FORTH THE TERMS BY WHICH TRAVEDOC INTENDS TO PROVIDE SERVICES TO USERS IN THE FUTURE. FOR THE PENDENCY OF THE BETA TESTING PHASE, HOWEVER, ALL PROCEDURES AND PRACTICES MAY NOT MEET THE TERMS DESCRIBED IN THIS AGREEMENT. USERS WHO USE THE SERVICE DURING THIS TIME ACKNOWLEDGE THIS FACT AND USE THE SERVICE SUBJECT TO ITS POTENTIAL NONCOMPLIANCE WITH THE TERMS OF THIS AGREEMENT. WHEN THE BETA PHASE ENDS, WE WILL REMOVE THIS DISCLAIMER FROM THIS AGREEMENT, AND THE USUAL TERMS WILL APPLY.
What Information Do We Collect?
Personal Information
- We collect the following information from physicians in connection with the Network: first and last name, title, gender, email address, telephone number, the city and country in which your practice is located, street address, medical specialty, available sites to see patients, language skills, appointment availability, and any hobbies or interests that you would like to share with potential patients.
- We collect the following information from patients in connection with the Network: first and last name, gender, date of birth, email address, telephone number, your preference to visit with a physician at your home or hotel or at the doctor’s office, the address of your hotel (if applicable), and information regarding your travel insurance or other method of payment.
The information that we collect from patients and physicians is referred to in this privacy policy as “Personal Information.”
Protected Health Information
Some “Protected Health Information” (as that term is defined at 45 C.F.R. § 150.613) covered under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and Subtitle D of the Health Information Technology for Economic and Clinical Health Act (the “HITECH Act”), or under equivalent foreign laws, may be disclosed between patients and physicians in the course of diagnosis and treatment. In corresponding with patients, physicians and their agents should be mindful of their privacy obligations under HIPAA and similar laws protecting the privacy of Personal Health Information in their country or jurisdiction of practice. The Network is intended merely to provide prospective patients with contact and other relevant information necessary to find and arrange to visit with a physician. TraveDoc does not wish to collect or receive Protected Health Information. Neither patients nor physicians should transmit Protected Health Information or related correspondence of any kind over the Network. Except as expressly described in this Privacy Policy, TraveDoc does not have any obligations of privacy or confidentiality with respect to any communications between physicians and patients or prospective patients.
Tracking Information
We, and our third party service providers, may use general web and cellphone tracking technologies such as cookies, web beacons, pixel tags and clear GIFs in order to operate the Network efficiently and to collect data related to usage and marketing of the Network. Such collected data (“Tracking Information”) may include the address of the websites you visited before and after you visited the Network, the type of browser you are using, your Internet Protocol (IP) address, what pages in the Network you visit and what links you clicked on, and whether you opened text message or email communications we send to you. In order to collect Tracking Information and to make your use of the Network more efficient, we may store cookies on your device. We may also use web tracking technologies that are placed in web pages on the Network or in communications to collect information about actions that users take when they interact with the Network or such communications, and TraveDoc’s Contractors (as hereinafter defined) may also do so. We do not correlate Tracking Information to individual user Personal Information. Some Tracking Information may include data that is unique to you. You may be able to modify your browser settings to alter which web tracking technologies are permitted when you use the Network, but this may affect the performance of the Network.
How Do We Use the Information We Collect?
Personal Information
We will use and store Personal Information for the purpose of connecting patients and physicians through the Network. We may also use Personal Information for the internal operational and administrative purposes of the Network.
Protected Health Information
If we collect any Protected Health Information, we will use it only in accordance with applicable law.
Aggregate Information
We will also use customer information to create aggregated data for analytical purposes. This statistical information does not contain any Personal Information and is used to understand our customer base and to better serve our market.
Tracking Information
We use Tracking Information to administer the Network and to understand how well the Network is working, to store your user preferences and customize the Network for you, and to develop aggregate, statistical information on usage of the Network. This allows us to determine which features users like best to help us improve the Network, to personalize your user experience, and to measure overall effectiveness.
Legal Exception
Notwithstanding the above, we may in any event use Personal Information and other information collected through the Network to the extent required by law or legal process, to resolve disputes, to enforce our agreements (including this privacy policy and the Terms of Service) with you, or if in our reasonable discretion use is necessary to protect our legal rights or to protect third parties.
Email and Text Message Communications
If you create an account and provide your email address and/or phone number, we will send you administrative emails and/or text messages. All users receive administrative emails, and so you cannot opt out of them while you remain an accountholder. If you wish to opt out of emails, you may do so by following the “unsubscribe” instructions in the email, or by editing your account settings. Users that use the Network to book appointments will receive confirmatory emails and/or text messages regarding those appointments.
What Information Do We Disclose to Third Parties?
Personal Information
We will not disclose your Personal Information to any third parties except (i) if you are a physician, your Personal Information (namely, the professional biographical information that you provide) will be published on the Network for viewing by any user; (ii) if you are a patient, your Personal Information may be disclosed to the physician with whom you request an appointment; and (iii) to third party contractors engaged to provide services on our behalf (“Contractors”), such as performing hosting and communications services, analyzing data and usage of the Service, operating the Service or providing support and maintenance services for the Service, or providing customer service. We enter into agreements with all Contractors that require them to use the Personal Information they receive only in connection with performing services for us.
Protected Health Information
We do not disclose Protected Health Information except as permitted or required by law.
Tracking Information
We disclose Tracking Information to physicians in order for physicians to analyze their participation in the Network.
Aggregate Information
We may disclose anonymous, aggregated information to third parties such as potential business partners, advertisers, and funding sources, in order to describe our business and operations.
Network Operators
Use of the Network may involve use of the services of third party telecommunications carriers. Such carriers are not our contractors, and any information that a carrier collects in connection with your use of the Network is not “Personal Information” and is not subject to this privacy policy. We are not responsible for the acts or omissions of telecommunications carriers.
Additional Disclosures
We reserve the right to disclose any information we collect in connection with the Network, including Personal Information, (a) to any successor to our business as a result of any merger, acquisition, asset sale or similar transaction; (b) in a medical or other emergency, to the extent reasonable under the circumstances; and (c) to any law enforcement, judicial authority, or governmental or regulatory authority, to the extent required by law or if in our reasonable discretion disclosure is necessary to enforce or protect our legal rights or to protect third parties.
Privacy Settings/Opt Out
If you would like your Personal Information permanently removed from our database, please contact us at legal@travedoc.com. We will promptly delete your account and you will no longer receive email from us. Your removal from the mailing list or database will not remove records of past transactions or delete information stored in our data backups and archives. Data on past transactions and data stored in backups and archives will be maintained and/or deleted in the ordinary course of our business.
Access and Updating of Information
TraveDoc is happy to allow you to review or amend your email address or contact details held in our database, at any time. Please contact us by sending an email to: legal@travedoc.com or by using your settings panel in your account on the Network.
General
Security
We use reasonable security precautions to protect the security and integrity of your Personal Information in accordance with this policy and applicable law. However, no Internet or cellphone transmission is completely secure, and we cannot guarantee that security breaches will not occur. Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties that breach our security procedures.
Links
The Network may contain links to other websites. TraveDoc is not responsible for the privacy practices or the content of those sites. Users should be aware of this when they leave our Network and review the privacy statements of each third party website. This privacy policy applies solely to information collected by the Network.
Amendments
TraveDoc may modify or amend this policy from time to time. If we make any material changes, as determined by us, in the way in which Personal Information is collected, used or transferred, we will notify you of these changes by modification of this privacy policy, which will be available for review by you on our website. Notwithstanding any modifications we may make, any Personal Information collected by TraveDoc from you will be treated in accordance with the privacy policy in effect at the time information was collected, unless we obtain your consent otherwise.
Children
TraveDoc does not knowingly collect or maintain personally identifiable information from persons under 13 years of age, and no part of the Network is directed at persons under 13. If you are under 13 years of age, then please do not use the Network. If TraveDoc learns that personally identifiable information of persons less than 13 years of age has been collected without verifiable parental consent, then TraveDoc will take the appropriate steps to delete this information. Network Visitors from outside the United States
TraveDoc and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access or use the Network, you consent to the use and disclosure of information in accordance with this privacy policy and subject to such laws.
